Terms and Conditions
The Contract
All persons applying for Siyafunda Wildlife & Conservation volunteer projects or My Kaya Safaris (Below referred both as Siyafunda Wildlife & Conservation) must complete an application/indemnity form on arrival. In the case of minors, a legal parent / guardian must sign an indemnity form. The person or persons who have completed the forms are hereafter referred to as the clients and/or applicants.
The client agrees to be bound by these application conditions. No agent, representative or client of Siyafunda Wildlife & Conservation has any right to alter, vary or waive any of these conditions. This contract, by whoever it is made and wherever it is made, is subject to and shall be governed and construed according to South African law.
Payment / Acceptance of Application
Once Siyafunda Wildlife & Conservation receives a provisional booking and invoice will be sent to the client via e-mail. The client must then pay 50% of the total fee to qualify for our projects (non-refundable, non-transferable, non-changeable). Please note that while provisional bookings are indications of project availability, placements are only confirmed upon receipt of the 50% deposit. Airfare and other travel arrangements should only be arranged after confirmation of a volunteer placement or safari.
The balance of the project price is payable in full 30 days before date of departure (for the entire program schedule). If the balance is not paid by the due date, Siyafunda Wildlife & Conservation reserves the right to disqualify the applicant. If an applicant applies 30 days or less before the start of the volunteer project or Safari, then the full price is payable at time of application.
Cancellation / Change by Client
Any notification of cancellation must be in writing. The date on which the letter/email is received by Siyafunda Wildlife & Conservation or its agents will determine the cancellation charges applicable. In the event of cancellation the following charges apply: more than 30 days before departure for entire project schedule (50%), less than 30 days before departure for entire project schedule (100%).
In certain unique situations, when agreed by all parties and to the benefit of the project (such as a change from high season to low season dates), Siyafunda Wildlife & Conservation may consider a date change for a $50 change fee.
Cancellation by Siyafunda Wildlife & Conservation
Siyafunda Wildlife & Conservation reserves the right to cancel any project. In the event of a project being cancelled for whatever reason, the client may choose a full refund of monies paid, less any used services, or alternatively any other project that Siyafunda Wildlife & Conservation is in a position to offer. No further liability by Siyafunda Wildlife & Conservation to the client with regard to the cancellation will arise.
Unused Services
In the event of a client failing to join a project, joining after departure, or leaving prior to completion, no refunds or liability will be accepted by Siyafunda Wildlife & Conservation. Unused services may not be traded or used by other clients. If a client leaves prior to completion, they must sign a release form and their participation in the project will be cancelled.
Changes
Siyafunda Wildlife & Conservation does not accept any liability arising out of changes to itineraries, or any other matters relating to a project, due to factors outside its control. These factors include wars, strikes, weather, political disputes, border closures, delayed flights, etc. Any expenses incurred by the client arising out of these changes are for their own account.
Travel Documents
All clients must be in possession of insurance, a valid passport, together with any necessary visas or required vaccinations, and the client accepts full responsibility for obtaining the same. Any information or advice given by Siyafunda Wildlife & Conservation or its agents with regard to the above is given in good faith, but Siyafunda Wildlife & Conservation can accept no responsibility for the information given. Should a client be refused entry to any country due to incorrect or incomplete documentation, Siyafunda Wildlife & Conservation will not be held liable for any costs of such delays or repatriation costs for the client.
Authority on Project
The client accepts that at all times the decisions of the authorities will be final on all matters for the well being of the client.
Unsuitability
During a project should a client, in the sole opinion of Siyafunda Wildlife & Conservation or its duly authorized representative, be considered unsuitable for the project for any reason including, but not limited to, being in contravention of any rules/guidelines of the project as set out from time to time or any customs/laws of South Africa, or by reason of causing difficulty, inconvenience or annoyance to other clients, staff or management, then Siyafunda Wildlife & Conservation may disqualify the applicant. In such circumstances transportation to the nearest town will be provided. Siyafunda Wildlife & Conservation will not be liable to make any refund to the client, and no other liability by Siyafunda Wildlife & Conservation to the client will arise.
Limitation of Liability
Client bookings are accepted on the understanding by the client that certain risks exist as an inherent part of travel in South Africa, and clients undertake Siyafunda Wildlife & Conservation projects and associated expeditions entirely at their own risk. While Siyafunda Wildlife & Conservation takes every precaution to ensure the safety of clients, no responsibility can be accepted for any death, injury or loss that might occur to such clients, sustained from any causes whatsoever. The client and his/her dependents, heirs, executors, administrators or assigns, hereby indemnify and hold blameless, Siyafunda Wildlife & Conservation, its members, employees, representatives and agents from any claims of any nature and from any liability for delay, loss, damage, injury, illness or death arising from any cause whatsoever out of events related to or occurring during a project.
Price Increase
Siyafunda Wildlife & Conservation reserves the right to increase program prices due to any increases in fuel costs, park entrance fees or fluctuation of exchange rates.
Excursions
Clients participating in excursions out of Siyafunda Wildlife & Conservation projects do so at their own risk.
Clients are bound by the aforementioned terms and conditions and enrollment information must be complete and accurate. Any false declaration would render any claim whatsoever void and the client could further be held liable for prosecution by the laws governing South Africa.
Any activities undertaken during Siyafunda Wildlife & Conservation projects are at a client’s own risk and Siyafunda Wildlife & Conservation is indemnified against any claims whatsoever that may arise in connection with any injury, loss or damage during the activities at each destination or transport to and from each destination, in the knowledge that the program leaders will take all reasonable precautions for the safety and welfare of the participants. Costs in respect of any accident or illness which, in the opinion of the authorities, requires medical attention, are the client’s liability.
